How to Register the Land

You need to find out the land's market value, stamp paper value and fee from the concerned Sub-Registrar Office in which the land is located.

Then submit the documentation along with the stamp paper duly typed therein the details of the purchaser and the seller information.

The same stamp paper will be signed and stamped by the Sub-Registrar and you need to collect it from their office in person after two days from the date of submission.

Required Documentation

Layout plan approved by HUDA if it is in HUDA jurisdiction or by Cantonment if the land is in Cantonment jurisdiction.

Get the certificate from revenue department stating that the land is not exceeding 1,000 sq. meters. Individuals are permitted to sell up to 1,000 sq. meters of land only. Only societies (formed with a group of persons) are allowed to sell land beyond that area.

If the amount of registration exceeds the Income Tax ceiling for the present financial year then the purchaser should submit the Income Tax returns certificate.

Whether the land is mortgaged property, Bhoodan property, Ex-servicemen property. Because if the land is mortgaged then it cannot be purchased. If it is Bhoodan property one cannot sale the property only transfer the property to their kit and kin? If it is Ex-servicemen land he cannot sell the land only he can transfer the property to his kit and kin or any blood relations.

Whether the land is ancestral property and who are the owner/owners for that land.

If it is more than 1 acre then we have to check 'Pahani'. Pahani is a revenue document (not a registered document) issued by M.R.O (Mandal Revenue Officer, Tasildar) that has the complete history of the land. It is normally issued for agricultural lands.

Registration Fee

Each area has its own market value further divided into Survey Numbers. Under Cantonment jurisdiction: 12% of the Present Market Value in that particular area and Survey number. It is 14% under Municipal Corporation.

For registering Gift Deed, the percentage of registration is 3% Stamp papers and 1% fees. Gift Deed is applicable only if the person is selling to his/her kit and kin, and blood relations.

For registering partition deed the percentage of registration is 3% Stamp papers and 1% fees.

In case of Will Deed, the fee is a fixed amount, Rs. 62/-.
